1. Purpose
This document sets out the privacy policy relevant to the collection, use, disclosure, and storage of personal information of any individual who is a job applicant, labour-hire worker or other independent contractor or an employee of Voyages Indigenous Tourism Australia Pty Ltd ACN 146 482 591 ("Voyages", "our" or "us").
2. Types of Personal Information Collected
If you are applying for a job with us or if you are providing a service to us under a labour-hire or independent contractor workplace arrangement with us, then the types of personal information that we may collect includes but is not limited to: your name, date of birth, contact details, qualification details, employment history, tax file number, bank account details, superannuation fund details, photograph, referee contact details, on-boarding process or workplace engagement process.
If you do not provide us with your personal information we may not be able to process your job application or proceed with your labour-hire or independent contractor workplace arrangement.
3. Sensitive Information
We may also collect sensitive information. The sensitive information collected by us may include but is not limited to: religious or cultural information, criminal record, fingerprints for identification purposes within the Voyages time and attendance system, accessibility or other support needs and limitations due to a person's individual circumstances and health information.
We will only collect sensitive information with your consent and where it is necessary for genuine business purposes, for the inherent requirements of your position and workplace duties at Voyages and/or for any other lawful purposes.
4. Methods of Collection
We collect your personal information directly from you (whether verbally or in writing).
Where relevant and with your consent, we may also collect your personal information from third parties such as a recruitment service provider, your previous employers, your referees, academic institutions to confirm your qualifications, public authorities or government agencies or medical professionals (if required to confirm your ability to perform the inherent requirements of your position and workplace duties at Voyages). We may also collect your personal information through publicly available information.
5. Purposes
We will not use or disclose personal information for any secondary purpose, unless that secondary purpose is related to the primary purpose for which we have collected that information, and you would reasonably expect the disclosure in the circumstances, or unless you consent to that use or disclosure, or unless we are required or authorised by law to use or disclose it.
The purposes for which we hold, use, disclose and process your personal information include:
(a) to facilitate recruitment or engagement including, without limitation, assessing suitability for employment or engagement;
(b) to undertake pre-employment and pre-engagement screening including, without limitation, undertaking probity and reference checking, immigration and related checking and facilitating medical checks (where required);
(c) for security, safety, operational and risk management purposes (e.g. security monitoring and emergency and incidents monitoring, investigation and reporting);
(d) for any purposes relating to your position and workplace duties (e.g. to arrange training and personal development, to facilitate travel arrangements, to administer any test or assessment (including medical tests and assessments) or to ensure compliance with our policies);
(e) for administrative purposes and the operation of our business (e.g. establishing access to information technology systems, payroll management and other human resources related purposes and to maintain records that we are required to maintain in relation to our business);
(f) to comply with any law, regulation, rule or requirement of any government authority; and
(g) to obtain legal or accounting advice
6. Storage
We take reasonable steps to ensure the security and integrity of the personal information we hold including restricted server access, encryption and other industry standard security protocol like use of firewalls and complex password protection. Authorised access is limited to authorised personnel and service providers who require access in connection with the purposes described in this policy.
7. Disclosure
We will ever disclose personal information to other individuals or organisations for the purpose for which it was collected, with consent or as permitted by law.
We may disclose personal information to those parties involved in providing, managing, or administering the products and services utilised by us. This could include:
(a) organisations involved in undertaking employment related checks on our behalf including without limitation, organisations performing pre-employment and pre-engagement screening, probity and reference checking and immigration and work visa checking;
(b) organisations involved in our payment systems including merchants, banks, payment organisations and tolling organisations in the case of airline transactions;
(c) organisations involved in our business activities including our business partners, agents, contractors and debt collectors;
(d) organisations that maintain, review and develop our business systems, procedures and technology infrastructure including IT service providers;
(e) related entities of Voyages; and
(f) professional advisors such as accountants, auditors, insurers and lawyers.
Some of the organisations to which Voyages may disclose personal information are located outside Australia or have technology systems located outside Australia.
8. Accuracy of Personal Information
You are responsible for ensuring that the personal information that you provide to us is accurate, complete and up-to-date at the time it is provided and you must notify us of any change. If you become aware that your personal information requires correction or updating then you can request that your information be corrected or updated. All requests must be in writing and directed to your People & Culture Representative. We will respond to your request within a reasonable period after receipt of your request. If there is a reason under the Privacy Act or any other law for us to refuse your request, then we will notify you in writing of those reasons.
9. Employee Records Exception
If you are an employee or a former employee of Voyages, then your employee records (i.e. personal information held by us relating to your employment with us) is exempt from the application of the Privacy Act and the Australian Privacy Principles if the use or disclosure of your personal information is directly related to a current or former employment relationship with Voyages.
10. Complaints
If you wish to make a complaint about how we have handled your personal information, please submit your complaint in writing to your People & Culture Representative or by emailing [email protected]. We will respond to your complaint within a reasonable period after receipt of your complaint. If you do not consider our response to your complaint satisfactory, you can contact the Office of the Australian Information Commissioner at www.oaic.gov.au.
11. Changes to this Policy
We will review and update this policy from time to time as needed without notice. You should review the terms of this policy periodically to make sure that you are aware of how we collect, store, use, disclose and process personal information.
